Privacy Policy

1. Purpose

INFORICH AMERICAS INC. and its affiliates (collectively, “INFORICH”, “we”, “us”, or “our”) operate a battery-sharing service under the C-Power brand, which enables users to rent portable batteries through physical charging stations and, where applicable, through our mobile applications and related digital platforms.

We respect your privacy and are committed to protecting your personal information. This privacy policy (the “Privacy Policy”) explains how we collect, store, use, disclose, and otherwise process personal information in connection with your use of our C-Power brand services in the United States.

2. Scope and Application

This Privacy Policy applies to individuals located in the United States, including residents of the State of New York, who interact with or use our services, including:

  1. our physical battery rental stations located at partner venues;
  2. our mobile applications and related software platforms;
  3. our websites and online services; and
  4. any customer support, communications, or other interactions you have with us,

(collectively, the “Services”).

3. Our Role

For the purposes of this Privacy Policy and applicable privacy and data protection laws, including the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the “CCPA/CPRA”), INFORICH acts as the controller, business, or equivalent responsible entity (as applicable under relevant law) in relation to the personal information processed in connection with the Services.

INFORICH determines the purposes and means of collecting, using, disclosing, storing, and otherwise processing personal information relating to users of the Services, including where users interact with our battery rental stations, mobile applications, websites, venue partners, distributors, or other commercial partners.

4. Personal Information We Collect

We collect, receive, and otherwise process personal information about you in connection with your use of the Services. The types of personal information we collect depend on how you interact with us (e.g., using a C-Power brand station, registering an account, making a payment, or contacting customer support), and may include the following categories:

  1. Identification Information: Such as your name and, where voluntarily provided or required for specific services, age or similar identifying details.
  2. Contact Information: Such as your email address, telephone number, and, where applicable, your billing or correspondence address.
  3. Usage and Transaction Information: Including details relating to your use of the Services, such as battery rental activity (including rental and return times, locations, and duration), transaction history, billing details, payment status, and records of services accessed, as well as information about how you interact with and use the Services.
  4. Device and Technical Information: Such as your Internet Protocol (“IP”) address, device identifiers, operating system, browser type, application version, log data, and other technical information relating to your device and connection to the Services.
  5. Location Information: Including approximate location derived from your IP address and, where enabled through your device settings or application permissions, more precise geolocation data.
  6. Marketing Information: Such as your preferences in receiving marketing communications from us, your consent choices where applicable, and your interactions with our marketing messages and campaigns.
  7. Communication Content: Including information you provide when you communicate with us, such as customer support inquiries, feedback, survey responses, reviews, ratings, and any other content or information you choose to submit.
  8. Call Recordings: Where permitted by applicable laws, recordings of telephone calls and related information when you interact with our customer support services for quality assurance, training, and dispute resolution purposes.

We collect personal information directly from you (for example, when you register, transact, or communicate with us), automatically through your use of the Services (including through device and usage data collection technologies), and from third-party sources.

We may also receive personal information about you from third parties, including:

  1. payment processors and financial service providers, in order to facilitate and verify transactions;
  2. analytics and technology providers, to help us understand how the Services are used and to improve performance and functionality; and
  3. business partners and venue operators, including entities that host C-Power brand stations or otherwise support the delivery of our Services.

We use and disclose the categories of personal information described above for the purposes set out in this Privacy Policy.

In certain circumstances, we may combine personal information collected from different sources to enhance our ability to provide, secure, and improve the Services, and to support our business operations.

5. How We Use Personal Information

We may use personal information for the following purposes:

  1. to provide and operate the Services;
  2. to process transactions and payments;
  3. to manage customer relationships and communications;
  4. to improve, analyze, and develop our Services;
  5. to send marketing communications (subject to opt-out rights);
  6. to comply with legal obligations;
  7. to detect, prevent, and address fraud and security issues; and
  8. for other legitimate and lawful business purposes consistent with this Privacy Policy.

6. How We Disclose Personal Information

We may disclose personal information to third parties in connection with operating our business, providing the Services, and complying with applicable legal obligations. Such disclosures are made for legitimate business purposes and subject to appropriate contractual and operational safeguards where required.

In particular, we may disclose personal information to:

  1. service providers, including vendors and contractors that perform services on our behalf, such as cloud hosting, data storage, payment processing, customer support, analytics, and IT services, where such parties are authorized to process personal information only as necessary to provide services to us and in accordance with our instructions;
  2. affiliates within the INFORICH Group, for internal business, operational, administrative, and support purposes, including to help deliver, maintain, and improve the Services across our global operations;
  3. business partners, such as venue operators and other partners that host or support C-Power brand stations or otherwise participate in the delivery of the Services, where disclosure is necessary to enable the operation, management, or improvement of the Services;
  4. legal and regulatory authorities, courts, law enforcement agencies, or other governmental bodies, where we are required or permitted to do so by applicable laws, regulations, legal process, or to protect our rights, property, or safety, or that of our users, partners, or others; and
  5. transaction counterparties and their advisors, in connection with actual or proposed mergers, acquisitions, financing transactions, restructurings, or sales of all or part of our business or assets, subject to appropriate confidentiality protections.

We may also disclose personal information where necessary to enforce our terms, policies, rules or procedures, detect or prevent fraud or security incidents, or establish, exercise, or defend legal claims.

We do not sell personal information for monetary consideration and do not share personal information for cross-context behavioral advertising as defined under applicable laws.

We also do not disclose personal information to third parties for their own independent marketing purposes except as otherwise described in this Privacy Policy or with your consent where required.

7. Your Rights and Choices

Depending on your state of residence and applicable laws, you may have certain rights regarding your personal information, subject to applicable exceptions and limitations.

These rights may include:

  1. Right to Know / Access: You may have the right to request access to the personal information we have collected about you, including information about the categories of personal information collected, the purposes for which it is used, and the categories of third parties to whom it has been disclosed;
  2. Right to Correction: You may have the right to request that we correct inaccurate personal information that we maintain about you;
  3. Right to Deletion: You may have the right to request that we delete personal information we have collected from you, subject to certain exceptions (for example, where retention is required for legal, security, or operational purposes);
  4. Right to Opt-Out of Sale or Sharing: You may have the right to opt out of the sharing of your personal information for cross-context behavioral advertising, as defined under applicable laws. We do not sell personal information for monetary consideration. If our practices change, we will update this Privacy Policy and provide any required opt-out mechanisms;

We may need to verify your identity before processing your request. In certain cases, we may request additional information to confirm your identity or authority to make the request.

You may also designate an authorized agent to submit a request on your behalf, where permitted by applicable laws. We may require proof of such authorization and verification of identity.

Please note:

  1. certain rights may be limited depending on applicable laws and the nature of the request;
  2. we may retain certain information as required or permitted by law, including for legal, security, and operational purposes; and
  3. where we rely on your consent for specific processing activities, you may withdraw your consent at any time, without affecting the lawfulness of processing prior to withdrawal.

9. Data Retention

We retain personal information for as long as reasonably necessary to fulfil the purposes for which it was collected, including to provide and operate the Services, comply with our legal and regulatory obligations, resolve disputes, and enforce our agreements.

The specific retention period for personal information may vary depending on the nature of the information and the purposes for which it is processed, including:

  1. the duration of your relationship with us and your use of the Services;
  2. applicable legal, tax, accounting, and regulatory requirements;
  3. the need to maintain records for security, fraud prevention, and dispute resolution purposes; and
  4. our legitimate business needs, such as improving and developing our Services.

Where personal information is no longer required for these purposes, we will delete, anonymize, or otherwise securely dispose of it in accordance with our data retention practices and applicable laws.

In certain circumstances, we may retain personal information for longer periods where required or permitted by law, including where such retention is necessary for compliance, legal claims, or regulatory investigations.

10. Data Security

We implement and maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, acquisition, disclosure, alteration, and destruction, in accordance with applicable laws, including the requirements of the New York SHIELD Act.

These safeguards are designed to be appropriate to the nature and sensitivity of the personal information we process and the risks associated with our operations, and include, among other measures:

  1. Access Controls: Including restricting access to personal information to authorized personnel and service providers on a need-to-know basis, and implementing authentication and authorization mechanisms.
  2. Technical Security Measures: Such as encryption in transit and at rest where appropriate, secure system configurations, and protections against unauthorized access or misuse of systems and data.
  3. Monitoring and Incident Response Procedures: Including logging and monitoring of systems, detection of suspicious activity, and processes to investigate, contain, and remediate security incidents in a timely manner.
  4. Organizational Safeguards: Including internal policies, procedures, and training designed to promote appropriate handling of personal information and to mitigate security risks.
  5. Vendor and Third-Party Risk Management: Including due diligence and contractual safeguards to ensure that service providers processing personal information on our behalf implement appropriate security measures.
  6. Physical Security Measures: Where applicable, designed to protect facilities, hardware (including C-Power brand stations), and related infrastructure from unauthorized access or interference.

While we take reasonable steps to protect personal information, no method of transmission over the internet or method of storage is completely secure. Accordingly, we cannot guarantee absolute security.

In the event of a security incident involving personal information, we will take appropriate steps to investigate and respond in accordance with applicable laws, including providing notifications where required.

11. Cookies and Tracking Technologies

We use cookies and similar tracking technologies (such as web beacons, pixels, and device identifiers) to collect and use personal information about your interactions with the Services. These technologies may be used for analytics and, where applicable, marketing or advertising purposes.

Where required by applicable laws, we will provide additional notice or obtain consent in relation to the use of certain tracking technologies. Please refer to our Cookie Policy for further information.

12. International Data Transfers

Due to the global nature of our business, your personal information may be transferred to, stored in, and processed in jurisdictions outside of your state of residence, including outside of the United States.

In particular, we may transfer personal information to:

  1. countries where our affiliates or group companies operate; and
  2. jurisdictions where our service providers or partners maintain operations or infrastructure.

These jurisdictions may have data protection laws that differ from those in your place of residence. Where we transfer personal information across borders, we take reasonable steps to ensure that appropriate safeguards are in place to protect your personal information in accordance with applicable laws.

13. Children’s Privacy

Our Services are not directed to, and are not intended for use by, individuals under the age of 13.

We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without appropriate authorization, we will take steps to delete such information in accordance with applicable laws.

14. Exclusions

This Privacy Policy applies only to personal information that we collect and process in connection with the Services.

It does not apply to:

  1. third-party websites, applications, or services that are not owned or controlled by INFORICH, including those that may be accessible through links or integrations within the Services;
  2. third-party payment processors or financial service providers, which process personal information independently in accordance with their own privacy policies; or
  3. business partners or venue operators where they collect or process personal information independently of INFORICH in connection with their own operations.

Such third parties may have their own privacy practices and policies, and we are not responsible for those practices. We encourage you to review the privacy policies of any third-party services you access or interact with.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our business practices, technologies, legal requirements, or other factors.

When we make changes, we will update the “Last Amended” date at the top of this Privacy Policy. Where required by applicable laws, we will provide additional notice of material changes, such as by posting a notice on our Services or notifying you directly.

Your continued use of the Services following any updates to this Privacy Policy constitutes your acknowledgment of those changes, to the extent permitted by applicable laws.
